1. Agreement to use this website properly
This website is operated for EMB Designs by Astros Marketing (Pty) Ltd and provides general information about embroidery, printing and related promotional services. The content is intended for businesses, schools, clubs and other customers in Durban North, Umhlanga, Westville, Pinetown, Ballito and surrounding areas that request a quotation or service through the enquiry form.
By using the site you confirm that you are legally able to enter into agreements, and that any information you submit is true, current and accurate. You must not use the site in any way that disrupts access, damages the site, or interferes with enquiry handling, artwork checks, sampling, production or dispatch processes.
- Use the site for lawful purposes only.
- Do not submit false or misleading order details.
- Do not attempt unauthorised access to systems or data.
- Do not copy or reuse site content without permission.
2. Enquiries, quotations and order acceptance
Submitting an enquiry through the contact page does not create a binding order. Any quotation, lead time, rush option, sample run or delivery arrangement is subject to confirmation by EMB Designs after review of the artwork, product type, quantities and production capacity. Optional 24-hour turnaround requests are only available where confirmed in writing and where the order details allow for it.
Pricing may change if garment sizes, branding areas, stitch counts, print methods, item availability or delivery requirements change after the initial request. Orders are accepted only once the required details, approvals and payment terms have been confirmed. Where a customer supplies logos, names or artwork, the customer remains responsible for having the right to use that material.
- Quotations are valid for the period stated on the quotation.
- Rush work depends on capacity, approval and stock availability.
- Bulk orders may require staged production or scheduled delivery.
- Artwork approved by the customer is treated as final for production.
3. Artwork, branding and production details
EMB Designs provides logo digitising, embroidery, screen printing, heat press printing, cap branding and promo item printing. Every job is subject to artwork review and production checks, but final responsibility for spelling, layout, colour references, names and logo content remains with the customer once approval is given. Small colour differences may occur between screen display, digital proof, fabric, thread, ink and finished products.
Natural fabric variation, supplier batch differences and the condition of supplied garments can affect the final result. This is normal in embroidery and print work, especially on mixed fibres, dark garments, curved cap panels and items exposed to coastal humidity or heavy use in the eThekwini area.
- Allow for slight colour variation between samples and final goods.
- Check all names, numbers and spellings before approval.
- Confirm garment sizes before uniform packs are produced.
- Client supplied items are used at the customer’s own risk.
4. Intellectual property and content ownership
All text, layout, images, product descriptions, process notes and other content on this website belong to EMB Designs or are used with permission. You may view the site and print reasonable extracts for internal reference only. You may not reproduce, distribute, alter or publish the content without prior written consent.
Where EMB Designs creates digitised artwork, layout files or production-ready files for a specific order, ownership of those files remains subject to the agreement reached for that order and any outstanding payment obligations. The customer is responsible for ensuring that any logos or brand marks submitted do not infringe another party’s rights.
- No copying of website content for resale or marketing use.
- No use of EMB Designs images or text on another website without consent.
- Digital files may be withheld until accounts are settled where applicable.
5. Delivery, collection and risk
Where delivery is arranged, timelines are estimates and may be affected by weather, load shedding, traffic, supplier delays or municipal restrictions. Packaging and delivery are handled with reasonable care, but risk in the goods passes according to the agreed handover point, whether collection from the Durban North base or delivery to the customer’s nominated address.
Customers should inspect goods promptly on receipt and report visible issues within a reasonable time. If products are stored, washed, ironed, distributed or used before inspection, it may limit the ability to assess a claim. EMB Designs is not responsible for delays caused by events outside its reasonable control.
- Inspect items as soon as they are received.
- Report shortages or damage promptly.
- Keep proof of delivery or collection where applicable.
- Follow care instructions for embroidered and printed garments.
6. Liability, privacy and changes to these terms
The website is provided on an as is basis for general business use. To the extent allowed by South African law, EMB Designs and Astros Marketing (Pty) Ltd are not liable for indirect loss, lost profits, missed deadlines, or losses arising from reliance on information that was incomplete, outdated or not yet confirmed on a quotation. Nothing in these terms limits liability that cannot legally be excluded.
Personal information submitted through the enquiry form is used to respond to requests, prepare quotations and manage orders. By using the form you consent to reasonable processing of that information for those purposes. These terms may be updated from time to time and the latest version will apply from the date it is published on the website.
- Use the enquiry form for service requests and order questions.
- Keep your own records of approvals and order details.
- Review these terms from time to time for changes.
